WAIVER AND DISCLAIMER

In consideration ONE.61 Digital Academy LLC ("Stay Safe Digital Academy”) its owner(s), the premises upon which training occurs, including each of their affiliates, subsidiaries, members, employees, officers, instructors, aides, and/or agents (the “Released Parties”), furnishing services, equipment, and/or curriculum and permitting the undersigned to participate in this course (the “Course”), the Participant agrees to all of the following:

Participant expressly agrees and understands that he/she assumes all risks and that Stay Safe Digital Academy is released from any and all liability for injury or harm to Participant’s person or property as a result of Stay Safe Digital Academy training.

Stay Safe Digital Academy does not assume any responsibility or culpability should a Participant willfully misuse techniques learned from Stay Safe Digital Academy in the commission of any crime, regardless of location.

Stay Safe Digital Academy teaches defensive personal protective techniques and provides advice on personal privacy, security, and safety. These techniques and related instruction are designed to improve one’s privacy, security, and safety. Stay Safe Digital Academy , does not, however, guarantee one’s privacy, security, and safety and Stay Safe Digital Academy disclaims any liability should a Participant suﬀer a calamity, regardless of severity.

Participant understands and agrees that: (a) there are DANGERS AND RISKS OF INJURY, DAMAGE, EMOTIONAL TRAUMA, OR DEATH that exist in my participation in the Course; (b) my participation in the Course may result in injury or illness; (c) this program may place the participant in uncomfortable physical or mental scenarios, or expose the participant to uncomfortable scenarios; all such scenarios are optional and voluntary on the part of the participant; (d) these risks and dangers may be caused by negligence of Released Parties, other Course participants, or others, and may arise from foreseeable or unforeseeable causes; and (d) by participating in the Course, I, on behalf of myself, my personal representatives and my heirs, hereby knowingly and voluntarily assume all risks and all responsibility, and agree to release the Released Parties for any injuries, losses and/or damages, including those caused solely or in part by negligence of the Released Parties or any other person.

I HAVE READ THIS AGREEMENT AND BY DIGITALLY ACCEPTING, I AGREE TO THE ABOVE TERMS, AND TO ASSUME ALL RISKS AND RELEASE THE ABOVE-NAMED RELEASED PARTIES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

This waiver and disclaimer shall be construed in accordance with the laws of the state of Florida, USA.
